Bigweld reserves the right, at its discretion, to modify, alter or update this website, policies and these Terms at any time. We take all care to ensure that the information on this website is correct but we do not guarantee its accuracy, so Bigweld shall not be held liable for any loss or damage that may result from inaccuracies in our website information. By continuing the use of this website, you agree to accept our terms and conditions. In these Terms and Conditions:
i) “Bigweld”, “We”, “Our”, “Us”, "Company" means Bigweld Pty Ltd (ABN 49 854 339 780) and includes its related directors, employees and agents.
ii) “Terms” means these Terms and Conditions of Use.
iii) “Site” means this website under the domain name www.bigweld.com.au.
iv) “You”, “Your”, “Customer” means the person or entity acquiring a product or using the Site. The “Hirer” means the Customer that is hiring any of Bigweld’s goods.
Access and use of this site
This website contains information about the products and services offered by Bigweld.
Your use of this Site authorises Your acceptance and agreement to be bound by our Terms, Privacy Policy and any further policies. If You do not agree to these Terms, please discontinue use of the Site and its content.
Your email address may be collected for marketing purposes and You are entitled to unsubscribe at any time. Your email will be held for transactional purposes.
Information on this site
The Site and its content are subject to copyright, trademarks and other intellectual property rights, owned by Bigweld.
You must not reproduce, modify or publish or otherwise use any of the material on the Site, with the exception of permission by Our prior written consent.
Due to photographic limitations associated with the representation of products, some actual products may differ from its visual appearance on the Site. Where suitable, some depictions of products are created or decided by Us for marketing purposes and may not be an exact representation of the goods received. All images are for illustration purposes only.
Information about goods on the Site is based on information provided by suppliers and/or manufacturers. Except as required by law, We cannot be held responsible for inaccuracies caused by incorrect information supplied to Us or by third parties.
Goods and services
Our goods comply with any technical specifications provided by Us, the manufacturer or supplier. It is not guaranteed that the goods are suitable for Your intended use and You are solely responsible for determining the use of the goods.
Goods are supplied on the condition that the title to the goods does not pass until payment in full has been received.
All legal costs in any action to recover a debt will be at the expense of the Customer.
All goods sold are subject to the manufacturer’s guarantee.
Failure to pay Your account by the due date may result in credit sales being suspended until the total amount owing is paid.
We do not provide any warranties in relation to our goods and services.
Gas cylinder rentals
Goods given for hire are to be kept in good condition and working order at all times. Damage caused by neglect or misuse will be charged to the Hirer in full. The Hirer accepts full responsibility for the safekeeping and insurance of the hired goods at all times, whilst in the possession of the Hirer, or the Hirers agents.
Title to the hired goods remains with Bigweld at all times and no right is assigned to the customer in respect of the sale of the goods, transfer, mortgage or assignment of the goods to others.
The Hirer undertakes to keep the owner informed at all times where the hired goods are located.
Customer-owned gas cylinders
Bigweld offers customer-owned gas cylinder refills. However, we do not refill BOC, ALA, CORE GAS and SUPAGAS cylinders under any circumstances. Please contact us for more information regarding refills of Your own gas cylinders.
Pricing
While Bigweld invests effort to keep product prices up to date, prices quoted by Bigweld are subject to change without notice. Changes may occur to enable increases in the cost of labour, materials, taxes or other levies. Bigweld reserves the right to increase prices without notice and the price charged will be the ruling price at the time of delivery. We will try our best to ensure that our prices match with other stores and suppliers. All prices quoted are inclusive of GST, unless stated otherwise.
Ordering goods and payment
Requesting a quote via the Site
The Customer may request a quote via the Site by selecting items of interest in accordance with these Terms and as directed on the Site. The Site will automatically generate a User Account using the Customer's details provided, in accordance to the Company's Terms and Privacy Policy.
Bigweld will invest its efforts to respond with a quote as soon as possible, and the Customer will receive an email with the particular products' corresponding prices. By requesting a quote via the Site, You are expressing interest in our goods. To accept this online quote, You must pay online using Your user account. The Company reserves the right, in its sole discretion, to decline any order or part thereof, in which it will be deemed cancelled.
Any order (a quotation made by the Company, that has been accepted and paid for by the Customer) made by the Customer is not binding on the Company until accepted by the Company in writing. A contract will be formed upon the written acceptance by the Company.
Payment options
We accept Visa and MasterCard. There is no surcharge for Via or MasterCard transactions. You must provide Your exact details and billing address. We also accept direct debit payments. If paying to accept Your quote, we accept payment by card or bank wire. You are required to transfer the invoice amount to our bank account before receiving an order confirmation with the order number. We accept cash payments in-store.
Delivery
Bigweld aims to deliver products to you by the time requested by you but we may not be able to guarantee firm delivery dates or times. Please contact us to ensure we can deliver your goods as necessary.
You must ensure you are able to receive the delivery of your order without undue delay and at any time reasonably specified by us.
If we are unable to deliver to your location, we will inform you and/or arrange for cancellation of the order or delivery to an alternative address. We may charge you for reasonable storage fees and other reasonable costs incurred by us; cancel your order, in which we will refund your money in accordance with our returns policy, and/or apply any administration charges. Unless specified by you, all risk in your product shall pass to you upon delivery. After the delivery is made, we will not be liable for loss or destruction of the goods. You must take care when using our products.
A delivery docket is to accompany all deliveries made, quoting the purchase order number, quantity of goods dispatched, description of supplies and delivery details. Ownership to the goods described in Our delivery docket shall not pass until full payment has been received.
Cartage on all deliveries may be charged as extra.
Same day delivery
For same day delivery, all orders are to be made at least one day prior.
Returns
No returns or cancellations on special orders will be accepted unless the goods are found to be faulty and warrantable by the manufacturer. Credit for such goods will not be given until authorised by the manufacturer.
Faulty products
Bigweld aims to provide you with the highest quality goods. If you receive a product with a defect, please contact us as soon as possible so that we may help resolve the problem. Once the product is confirmed, we will replace, repair, or refund the good, as appropriate. However, if the product is found to not have a defect or otherwise does not comply with the Australian Consumer Law, we will organise returning the product to you. This includes the product being no longer saleable due to fair wear and tear, misuse, or failure to use according to the manufacturer's instructions.
Change of mind
A product may be returned as long as it is placed within 30 days of the delivery docket being serviced. It must remain in saleable condition. We will not refund any delivery fees.
Credit
Goods returned for credit will be accepted subject to the original suppliers accepting return and may be credited less a restocking fee where applicable.
Return of goods
No goods may be returned unless:
a) the Company has given prior authorisation;
b) the correct invoice number is quoted on the Customer's delivery docket; and
c) the return is made within thirty (30) days of the delivery docket being serviced.
Indemnification
The Customer shall indemnify the Company against all losses and expenses to which the Company may suffer or incur owing the failure of the Customer to fully observe its obligations under these Terms.
Use of our content
You are permitted to link to bigweld.com.au as long as it is non-commercial, is fair and legal and does not cause damage or take advantage of our reputation.
You must not misuse or tamper with Our Site, or otherwise mess with Our functionality or steal Our customer data. Bigweld will report any breach or activity to the relevant legal authorities.
The Site and its content must not be framed on any other site without Our permission.
Privacy
Our Privacy Policy, together with Our Terms sets Our why we collect data from You and how we may process it. Please read the Privacy Policy available on the Site carefully.
Promotions
Special Offer ending 28 February 2022
Offer is valid from Friday 18 February 2022 and ends Monday 28 February 2022 11:59pm AEDT, while stock lasts. The monetary amount specified in the promotion is in Australia Dollars (AUD), where the offer will apply to the final tax invoice inclusive of GST. Offer is non-transferrable; Promotions cannot be applied to previous purchases nor combined with any other offers or discounts, including price matching of any other retailer. Items will only be shipped to Australian addresses only. Returns and exchanges are subject to Bigweld’s return policy. Bigweld has the right to cancel or modify any promotion at any time without notice and in its sole discretion.
